Details About the Boise Brain Injury Accident Near Nez Perce-Clearwater National Forest

The Boise brain injury accident that occurred on August 10, 2024, has left the local community shaken. According to reports from the Idaho Statesman, the incident took place in the remote areas of the Nez Perce-Clearwater National Forest, a region known for its rugged terrain, limited cell service, and challenging emergency response conditions. When accidents occur in such locations, immediate access to advanced medical care is often delayed, increasing the risk of severe injuries such as traumatic brain injuries (TBIs).

Where the Accident Occurred

The accident happened deep within the Nez Perce-Clearwater National Forest, a vast wilderness that spans parts of north-central Idaho. This area is popular for outdoor activities, including hiking, camping, and off-road driving. According to Google Maps, the nearest urban center is Boise, Idaho, which is hours away by road. The remoteness of this area can make emergency rescues difficult, requiring coordination between local authorities, park rangers, and medical teams.

What We Know About the Incident

While official details remain limited, reports indicate that at least one individual sustained a serious traumatic brain injury during a recreational outing. Emergency teams reportedly worked to stabilize the injured person before arranging for transport to a nearby hospital. Accidents of this nature often require immediate medical intervention, including imaging tests, emergency surgery, or extended hospitalization, due to the long-term impact of brain trauma.

Why Brain Injuries Are Common in Wilderness Accidents

Outdoor environments, particularly in rugged Idaho forests, are fraught with risks such as falls, vehicle rollovers, or blunt-force trauma from recreational equipment. According to the Centers for Disease Control and Prevention (CDC), TBIs are among the most common injuries caused by falls and accidents, and they can have life-altering effects. The August 10 Boise brain injury accident serves as a stark reminder of the dangers associated with outdoor activities in remote terrain without proper safety measures or quick access to emergency services.

Common Causes of Brain Injuries in Remote Boise Accidents

The Boise brain injury accident on August 10, 2024, illustrates how quickly a routine outdoor activity can turn into a life-altering emergency. Traumatic brain injuries (TBIs) are some of the most severe outcomes of wilderness incidents, and they often result from preventable circumstances such as falls, vehicle rollovers, and improper safety measures. According to the Centers for Disease Control and Prevention, TBIs contribute to thousands of fatalities and hospitalizations each year, with recreational and outdoor accidents being a significant source of these injuries.

The Role of Falls in Traumatic Brain Injuries

Falls are one of the leading causes of TBIs, especially in rugged, uneven environments like the Nez Perce-Clearwater National Forest. Hiking trails, rocky outcrops, and steep inclines can create hazardous conditions for even the most experienced outdoor enthusiasts. According to the National Park Service, falls are among the most common causes of emergency rescues and fatalities in national parks and forests across the United States.

When a fall results in a blow to the head, the victim can suffer from concussions, brain swelling, or internal bleeding that may not be immediately visible. This is why wilderness safety experts recommend immediate evaluation after any impact involving the head. If emergency medical services are delayed, these injuries can worsen, leading to permanent cognitive damage or death.

How Slippery Terrain Contributes to Accidents

In wilderness areas around Boise, slippery conditions caused by rain, ice, or loose gravel can drastically increase the risk of falling. The Idaho Department of Parks and Recreation encourages hikers and campers to wear proper footwear with traction and to carry trekking poles for stability when navigating difficult terrain. Unfortunately, in remote settings like the Nez Perce-Clearwater National Forest, these precautions are not always enough, especially when trails are poorly maintained or marked.

The Importance of Safety Gear

Wearing helmets during activities such as biking, off-road driving, or climbing can significantly reduce the severity of brain injuries. Data from the Brain Injury Association of America shows that helmet use can lower the risk of life-threatening brain trauma by nearly 70 percent. However, many wilderness accidents still involve individuals who are not wearing protective gear, leaving them vulnerable to devastating injuries when falls or collisions occur.

Vehicle Accidents and Brain Injuries in Remote Areas

Motor vehicle and off-road vehicle accidents are another common cause of TBIs in Idaho’s backcountry. Whether it involves ATVs, side-by-sides, or SUVs, vehicle rollovers and collisions can create violent impacts that result in head trauma. The National Highway Traffic Safety Administration reports that head injuries are among the most frequent outcomes of off-road vehicle crashes, particularly when seatbelts and helmets are not used.

The Impact of Off-Road Rollovers

Off-road rollovers are especially dangerous because they often involve uneven terrain, hidden obstacles, or excessive speed. When a vehicle flips, occupants may strike their heads against hard surfaces or be ejected from the vehicle entirely. According to the Idaho Transportation Department, off-road and rural vehicle accidents remain a major concern, and drivers are urged to follow safety protocols to reduce the risk of traumatic injuries.

How Lack of Medical Access Intensifies the Risks

In remote locations like Nez Perce-Clearwater National Forest, medical access is limited. Unlike urban settings where paramedics and trauma centers are minutes away, wilderness rescues often involve delays that can worsen a TBI. The Mayo Clinic emphasizes that brain injuries require rapid intervention to prevent swelling and further brain damage. Even a delay of one hour can significantly increase the risk of permanent cognitive impairment.

Sports and Recreational Activities Linked to TBIs

Outdoor recreational activities such as mountain biking, rock climbing, and kayaking are popular near Boise, but they also carry significant risks. The American College of Sports Medicine highlights how head injuries are common in extreme sports, especially when participants fail to use appropriate protective gear.

Risks from Cycling and Mountain Biking

Cycling accidents are a frequent source of brain injuries in wilderness environments. The National Library of Medicine has published extensive studies confirming that cyclists who fail to wear helmets are at a much higher risk of suffering fatal or severe TBIs. On narrow trails and forest roads, cyclists can collide with rocks, trees, or other vehicles, resulting in high-impact head trauma.

Water Sports and Brain Injuries

Water-related activities, including rafting and kayaking, also pose unique dangers. A collision with rocks or being thrown against a hard surface during turbulent water conditions can cause severe head injuries. According to Safe Kids Worldwide, drowning incidents often involve head trauma that renders the victim unconscious before they enter the water. Using helmets and life jackets is critical when navigating Idaho’s fast-moving rivers.

Types of Brain Injuries and Their Long-Term Effects

Brain injuries vary significantly in severity, but all require careful diagnosis and treatment to prevent permanent damage. In incidents like the August 10, 2024, Boise brain injury accident, the consequences can be both immediate and long-lasting, affecting cognitive abilities, emotional health, and physical functioning. According to the Centers for Disease Control and Prevention, traumatic brain injuries (TBIs) are a leading cause of disability and death in the United States.

Mild Traumatic Brain Injuries and Concussions

Concussions are considered mild TBIs, but their impact should never be underestimated. Even a single concussion can result in symptoms like headaches, dizziness, memory loss, and difficulty concentrating. The Mayo Clinic warns that untreated concussions can lead to post-concussion syndrome, which may include persistent symptoms for weeks or months.

Recognizing Early Warning Signs

Victims may not immediately realize they have sustained a concussion. Symptoms like confusion, sensitivity to light, or blurred vision often appear hours later. Immediate medical evaluation, including imaging tests, is essential to rule out brain bleeding or swelling. Resources from the American Association of Neurological Surgeons emphasize the importance of early intervention for any head injury, even those perceived as minor.

Moderate and Severe Brain Injuries

Moderate to severe TBIs often involve extended loss of consciousness, skull fractures, or significant bleeding within the brain. These injuries typically require hospitalization, surgical intervention, and long-term rehabilitation. The Johns Hopkins Medicine notes that severe brain trauma can result in permanent cognitive deficits, including changes in personality, memory loss, and impaired motor skills.

The Role of Imaging and Specialist Care

For moderate to severe injuries, CT scans and MRIs are critical in assessing the full extent of the damage. Specialists such as neurologists and neurosurgeons use this data to determine whether surgery is necessary to relieve pressure within the skull. The Cleveland Clinic provides detailed information about the procedures used to treat acute brain injuries, including craniotomy and ventriculostomy.

Long Term Effects of Brain Injuries

Brain injuries can have profound and lasting consequences. Even after initial recovery, victims often experience lingering symptoms that interfere with their ability to work, drive, or perform everyday tasks. According to the Brain Injury Association of America, nearly half of all severe brain injury survivors require long-term care or rehabilitation services.

Cognitive and Emotional Impacts

Memory loss, impaired decision-making, mood swings, and depression are common in those recovering from TBIs. Studies from the National Institutes of Health show that damage to specific brain regions can alter personality and emotional regulation, creating significant challenges for both the victim and their family.

Physical and Neurological Challenges

Many TBI patients struggle with ongoing headaches, seizures, and balance problems. Some develop conditions like post-traumatic epilepsy, which requires lifelong management. Rehabilitation programs often involve a combination of physical therapy, occupational therapy, and speech therapy to restore as much function as possible.

Legal Implications of a Boise Brain Injury Accident

A brain injury caused by negligence or unsafe conditions often raises complex legal questions about liability, compensation, and long-term care. Victims of the August 10, 2024, Boise brain injury accident near Nez Perce-Clearwater National Forest may have the right to pursue a claim for damages if another party’s actions contributed to the incident. Navigating these legal challenges requires a deep understanding of Idaho personal injury laws and the unique issues associated with traumatic brain injury claims.

How Liability Is Determined in Brain Injury Cases

To recover compensation, a victim must establish that another party’s negligence directly caused the injury. In Idaho, negligence is defined as a failure to exercise reasonable care. For instance, if the brain injury was the result of a vehicle collision or hazardous conditions on public or private property, the at-fault party can be held responsible. Resources from the Idaho State Legislature outline the legal framework for personal injury claims, including the rules governing negligence and fault.

Comparative Fault Rules in Idaho

Idaho follows a modified comparative negligence system. This means that a victim can still recover compensation as long as they are less than 50 percent at fault for the accident. The total compensation, however, will be reduced by the percentage of the victim’s own fault. According to Idaho Code § 6-801, understanding how comparative fault is applied is crucial when negotiating settlements or presenting a case in court.

Damages Available in Brain Injury Claims

Compensation for brain injury victims often includes both economic and non-economic damages. Economic damages cover measurable losses, such as medical bills, rehabilitation costs, and lost income. Non-economic damages compensate for pain, suffering, emotional trauma, and diminished quality of life. As noted by the American Bar Association, these cases often involve extensive evidence, including medical records and expert testimony, to determine the true value of the claim.

Long-Term Medical and Financial Needs

Traumatic brain injuries frequently require ongoing care, such as physical therapy, cognitive rehabilitation, and mental health treatment. According to the National Institute of Neurological Disorders and Stroke, the lifetime cost of care for a severe brain injury can exceed several million dollars. A strong legal claim should include projected future expenses and lost earning capacity, ensuring the victim is adequately supported in the years ahead.

The Role of Expert Witnesses

Brain injury cases often hinge on the opinions of medical and financial experts. Neurologists, rehabilitation specialists, and life care planners provide testimony about the severity of the injury and the expected cost of ongoing treatment. The Brain Trauma Foundation offers detailed resources that help attorneys and medical professionals assess the full impact of TBIs. Expert witnesses also help illustrate how the injury affects the victim’s day-to-day life, from work-related limitations to changes in cognitive and emotional health.

Accident Reconstruction and Evidence Collection

When a brain injury is linked to a vehicle collision, ATV accident, or similar event, accident reconstruction experts may be called to analyze the scene. They use physical evidence, eyewitness accounts, and data from vehicles or devices to determine the cause of the incident. According to the National Highway Traffic Safety Administration, thorough evidence collection is critical to proving fault and securing fair compensation.

Why Legal Representation Matters

Brain injury cases are often far more complicated than standard personal injury claims. Insurance companies frequently dispute the severity of TBIs, especially when symptoms are not immediately visible. Victims who attempt to handle these claims on their own risk accepting low settlements that do not account for long-term needs. The Idaho State Bar recommends working with an experienced personal injury attorney who understands the medical, financial, and emotional toll of brain injuries.

Montgomery Dowdle’s Approach to Brain Injury Cases

At Montgomery Dowdle, our attorneys work closely with medical experts, rehabilitation specialists, and economists to build comprehensive cases for brain injury victims.
Safety Tips and Prevention Strategies for Avoiding Brain Injuries in Boise’s Wilderness

Preventing brain injuries in remote areas like the Nez Perce-Clearwater National Forest requires preparation, awareness, and adherence to safety measures. The Boise brain injury accident on August 10, 2024, is a sobering reminder that outdoor activities can become dangerous when safety precautions are ignored. According to the National Safety Council, proactive risk management and proper gear can significantly reduce the likelihood of traumatic injuries.

Preparing for Outdoor Activities in Idaho

A successful and safe trip begins with preparation. Wilderness areas near Boise are known for their challenging terrain, unpredictable weather, and limited medical access. Before venturing into remote locations, outdoor enthusiasts should familiarize themselves with the area and plan for emergencies.

Researching Trail and Terrain Conditions

Understanding the terrain is crucial for avoiding accidents. The U.S. Forest Service offers trail maps, safety tips, and seasonal hazard updates for national forests, including Nez Perce-Clearwater. Checking these resources before starting a hike or off-road activity can help avoid unstable ground, washed-out trails, or areas prone to rockslides.

Carrying Safety and First Aid Equipment

Carrying a well-stocked first aid kit, satellite phone, and helmet for high-risk activities like biking or off-roading is vital. The Red Cross provides guidelines on first aid essentials, including supplies to treat head injuries until professional medical help arrives. Early intervention is often critical in preventing complications from TBIs.

Helmet Use and Protective Gear

Wearing proper protective gear is one of the most effective ways to prevent brain injuries. Whether biking, ATV riding, or participating in climbing or water sports, a certified helmet can dramatically reduce the severity of an impact.

How Helmets Reduce Brain Injury Risk

The Centers for Disease Control and Prevention states that helmets can reduce the risk of serious brain injury by nearly 70 percent. Helmets absorb and distribute the force of an impact, minimizing the direct trauma to the skull and brain. Even short recreational rides can pose risks when a helmet is not worn, making this a non-negotiable safety measure.

Choosing the Right Helmet for the Activity

Different activities require specific helmet designs. For example, mountain biking helmets offer extended rear protection, while whitewater helmets are built to withstand repetitive impacts with rocks and equipment. Organizations like the Consumer Product Safety Commission maintain updated helmet safety standards that help users select the right equipment.

Reducing Risks From Vehicles and Off-Road Activities

Vehicle-related accidents are a major source of brain injuries in wilderness areas. Off-road vehicles like ATVs and side-by-sides are particularly prone to rollovers and high-impact crashes.

Safe Driving Practices in Remote Locations

Following safety protocols can prevent devastating crashes. The Idaho Transportation Department urges drivers to reduce speed on uneven or gravel surfaces, avoid steep embankments, and ensure passengers are using seat belts or harnesses. Driving defensively and staying within designated trails can prevent loss of control that leads to serious injuries.

The Importance of Operator Training

Many ATV and off-road accidents involve inexperienced drivers. Courses provided by the Idaho Department of Parks and Recreation offer critical instruction on vehicle handling, emergency response, and risk awareness. Proper training is essential for reducing the likelihood of catastrophic accidents.

Planning for Emergency Response

When an accident occurs in a remote location, quick medical intervention can save lives. Without proper planning, delays in emergency response can turn minor injuries into life-threatening situations.

Communication and Location Tracking

Carrying GPS-enabled devices, personal locator beacons, or satellite communication tools can drastically reduce the time it takes for emergency services to locate an injured person. The National Association for Search and Rescue recommends using location-sharing apps or devices to ensure rescuers can find victims quickly.

Knowing the Nearest Medical Facilities

Before beginning any outdoor adventure, it is important to identify nearby trauma centers or urgent care facilities. Boise residents and visitors can review emergency hospital locations through the Saint Alphonsus Health System and St. Luke’s Health System. In the event of a brain injury, time-sensitive treatment like CT scans and neurosurgery may be necessary to prevent long-term disability or death.

What We Know About the May 20 Motorcycle Crash on I-84 in Boise

The Boise motorcycle accident on May 20, 2025, remains under active investigation by the Idaho State Police. The crash occurred during daylight hours on westbound Interstate 84, one of the region’s most heavily traveled highways. Early reports suggest the rider was traveling at a high rate of speed when the motorcycle collided with the roadway barrier, ejecting the rider and causing critical injuries. Witnesses at the scene described a chaotic and traumatic aftermath as first responders raced to stabilize the injured motorcyclist.

This tragic crash highlights the extreme risks that motorcyclists face on high-speed corridors like I-84, particularly in fast-moving or congested traffic. It also raises important legal questions about fault, insurance coverage, and the rights of injured riders to seek compensation for medical expenses and other losses.

Where the Crash Happened on Interstate 84

According to the official Idaho State Police report, the crash took place on the westbound side of I-84 near milepost 51, close to the Cloverdale Road exit in Boise. This stretch of highway regularly sees high commuter volume and fast-moving traffic, especially during morning and evening rush hours. You can view the approximate crash site using this Google Maps link.

At the time of the crash, the motorcyclist was reportedly navigating through westbound traffic at excessive speed. The rider struck the concrete barrier on the median and was ejected from the bike. Emergency responders from Ada County and the Idaho State Police quickly arrived to render aid and transport the injured rider to a nearby trauma center.

High-Speed Riding and Lane Navigation on Idaho Highways

While the full investigation is ongoing, early evidence points to excessive speed and erratic maneuvering as contributing factors. Highways like I-84 are particularly dangerous for motorcyclists because of limited reaction time, high traffic density, and minimal room for error. When riders attempt to change lanes rapidly or ride at speeds that exceed traffic flow, the risks of losing control or colliding with vehicles or barriers increase dramatically.

The Idaho Transportation Department advises all motorcyclists to maintain a safe speed, wear appropriate safety gear, and avoid aggressive riding behaviors. Unfortunately, even skilled and cautious riders can be affected by dangerous road conditions, inattentive drivers, or sudden changes in traffic flow.

Ongoing Police Investigation and Evidence Collection

The Idaho State Police are continuing to investigate the crash. Their efforts include collecting physical evidence from the scene, analyzing skid marks and impact zones, reviewing any available dashcam or surveillance footage, and interviewing eyewitnesses. These findings will help determine whether any additional factors, such as road hazards, mechanical failure, or another vehicle’s actions, played a role in the crash.

Updates on the investigation will likely be released through the Idaho State Police Newsroom and the Crash Reporting Portal as new information becomes available.

Emergency Medical Response and Rider’s Condition

Paramedics at the scene transported the rider to a local hospital for treatment of life-threatening injuries. The current condition of the motorcyclist has not been released, and authorities have not disclosed the rider’s identity pending notification of family members.

In severe motorcycle crashes like this, injuries often include head trauma, spinal damage, fractures, and internal bleeding. These life-altering injuries not only require extensive emergency treatment but may also result in long-term rehabilitation and permanent disability. For more on motorcycle injury types, visit the CDC’s motorcycle safety page.

Why Motorcycle Accidents Are So Common on I-84 and Across Boise

Motorcycle accidents remain one of the most dangerous types of roadway incidents in Idaho, especially along high-speed corridors like Interstate 84. Boise’s rapid growth, increasing commuter congestion, and inconsistent infrastructure upgrades have created an environment where serious motorcycle crashes are becoming tragically frequent. The May 20 accident is not an isolated event. It is part of a broader public safety concern that affects every rider on the road.

Motorcyclists face unique challenges that drivers in passenger vehicles do not. They lack the protective frame of a car, they are less visible in traffic, and they are more vulnerable to sudden changes in road conditions. These vulnerabilities are amplified on roads like I-84, where high speeds, merging traffic, and distracted drivers combine to create extremely hazardous conditions.

To better understand why motorcycle crashes continue to rise in Boise and across Ada County, it is important to look at the contributing factors through the lens of public safety data, infrastructure design, and human behavior.

High-Speed Traffic and Infrastructure Mismatches

Interstate 84 runs through the heart of the Treasure Valley and serves as the primary commuting artery for thousands of Boise residents every day. According to the Idaho Transportation Department, this corridor was designed decades ago to prioritize vehicle throughput rather than multi-modal safety. That means motorcyclists must navigate interchanges, exit ramps, and shoulders that were never built with two-wheeled traffic in mind.

Even as traffic volume has surged in recent years, road design has remained largely static. Long stretches of I-84 still lack sufficient barriers, rumble strips, or widened shoulders to accommodate motorcyclists safely. The National Highway Traffic Safety Administration (NHTSA) reports that motorcycles are involved in fatal crashes at a rate nearly twenty-nine times higher than passenger vehicles per mile traveled. You can review the latest NHTSA findings on motorcycle crash risk to understand just how stark the statistics are.

Speed Limits and Driver Behavior on Idaho Interstates

The posted speed limit on I-84 varies between 65 and 80 miles per hour, depending on the segment. But the reality is that most vehicles travel well above those limits, especially during low-enforcement hours. For motorcyclists, even a small misjudgment by another driver becomes exponentially more dangerous when traffic is moving at such high speeds.

The Insurance Institute for Highway Safety has long warned that speed increases both the likelihood of a crash and the severity of injuries when one occurs. And on highways like I-84, there is little margin for error. A sudden lane change, abrupt braking, or debris in the road can be lethal for someone riding a motorcycle, even if that rider is fully licensed and wearing all appropriate safety gear.

Distracted Driving and Inattention to Motorcyclists

Distracted driving is one of the most common causes of crashes involving motorcycles. The Idaho Office of Highway Safety reports that thousands of accidents each year in the state are caused by drivers who were texting, adjusting in-car technology, or simply not paying attention.

Motorcycles are often overlooked by distracted drivers. Their smaller size and lower profile make them harder to see, especially when drivers fail to check mirrors or blind spots before turning or merging. The Centers for Disease Control and Prevention emphasizes that distractions behind the wheel reduce reaction times and impair judgment, significantly increasing crash risk for nearby riders.

Cellphone Use and Its Role in Motorcycle Collisions

Drivers using cellphones while behind the wheel present a serious threat to motorcyclists. Even hands-free devices have been shown to distract drivers cognitively, drawing attention away from the road and the movement of smaller vehicles like motorcycles.

According to the National Safety Council, drivers who are talking on the phone may still miss seeing a motorcyclist even when they appear to be looking directly at them. This phenomenon, known as inattentional blindness, is a leading factor in many side-impact or “left-turn” motorcycle collisions.

Boise’s Enforcement Challenges Around Driver Distraction

Although Idaho has banned texting while driving, enforcement remains inconsistent. The Boise Police Department and Idaho State Police continue to advocate for more resources and stronger penalties for distracted driving, but limited staffing and high call volumes mean that many violations go unpunished. The Idaho Legislature has passed some reforms, but advocates argue that more comprehensive policies are needed to change driver behavior statewide.

Unsafe Lane Changes and Blind Spot Incidents

Another major hazard for motorcyclists is the failure of other drivers to check blind spots before changing lanes. On I-84, where traffic moves quickly and space is limited, many drivers rely on their mirrors alone, a dangerous oversight when motorcycles are involved.

The National Highway Traffic Safety Administration recommends using both mirrors and a shoulder check to verify lane clearance before merging or overtaking. Unfortunately, far too many drivers skip this critical step, resulting in sideswipe crashes and forcing riders to veer suddenly or crash into barriers.

The Visibility Problem on Multi-Lane Highways

Motorcycles can easily become hidden in a car or truck’s blind spot, particularly during low-light conditions or inclement weather. Riders who position themselves properly in the lane are still at the mercy of inattentive drivers, especially when highway congestion leads to aggressive lane changes.

While some vehicles are equipped with blind spot monitoring systems, not all drivers use them correctly. Additionally, these systems may not always detect smaller or faster-moving motorcycles. The Society of Automotive Engineers has published research showing that sensor-based systems can fail under certain conditions, particularly at night or in heavy rain.

Driver Aggression and Road Rage Toward Motorcyclists

Riders in Boise frequently report incidents of road rage, tailgating, and intentional crowding by impatient drivers. These behaviors are not only aggressive, they are illegal and dangerous. The AAA Foundation for Traffic Safety found that nearly eighty percent of drivers expressed significant anger or aggression at least once in the past year, and motorcyclists are often the target of this frustration.

The Legal Implications of Aggressive Driving

Aggressive driving that leads to a crash may expose the driver to not only civil liability but also criminal charges in Idaho. Idaho Code § 49-1401 defines reckless driving as operating a vehicle with willful disregard for the safety of others, which includes harassing or intimidating behavior toward motorcyclists.

Law enforcement agencies and motorcycle advocacy groups such as ABATE of Idaho have called for stricter enforcement of these statutes and increased public education on how to share the road safely with motorcyclists.

Inadequate Road Maintenance and Lane Conditions

Motorcycles require stable surfaces to operate safely. Potholes, uneven pavement, gravel, and worn lane markings pose a much greater risk to a two-wheeled vehicle than to a car or truck. I-84 has several segments under continuous repair or renovation, but not all hazards are marked in time for riders to respond.

The Federal Highway Administration has identified poor infrastructure maintenance as a key factor in many single-rider motorcycle crashes, particularly those that occur without involvement from another vehicle. Uneven expansion joints, debris, and oil slicks can cause even experienced riders to lose control, especially at highway speeds.

Serious Injuries Commonly Sustained in Boise Motorcycle Accidents

Motorcycle accidents in Boise, particularly those occurring on major highways like Interstate 84, often result in catastrophic injuries. Unlike occupants of passenger vehicles, motorcyclists have little protection beyond a helmet and riding gear. When a crash occurs at high speeds, the consequences can be physically devastating and financially overwhelming. The May 20 motorcycle accident near Cloverdale Road illustrates how a single high-speed impact can lead to life-threatening trauma requiring emergency surgery, long-term hospitalization, and rehabilitation.

Understanding the types of injuries most commonly associated with motorcycle crashes helps victims and their families recognize the seriousness of their condition, seek appropriate medical care, and pursue the compensation they are legally entitled to under Idaho law.

Traumatic Brain Injuries Are Among the Most Devastating Outcomes

Head injuries are one of the leading causes of death and permanent disability in motorcycle crashes. Even when riders wear helmets approved by the U.S. Department of Transportation, the force of impact can still cause the brain to strike the inside of the skull. These injuries range from concussions to severe swelling, hemorrhage, or permanent brain damage.

The Centers for Disease Control and Prevention reports that motor vehicle crashes, including motorcycle accidents, are one of the top three causes of traumatic brain injury nationwide. Symptoms may not appear immediately after the crash, which is why emergency evaluation and follow-up imaging are essential even if a rider appears alert.

Long-Term Effects of Motorcycle-Related Brain Trauma

Riders who survive brain injuries may suffer from memory loss, impaired motor skills, mood disorders, and reduced cognitive function. Many need speech therapy, occupational rehabilitation, or ongoing psychological care. According to the Brain Injury Association of America, the long-term cost of managing a moderate to severe traumatic brain injury can exceed $3 million over a lifetime.

Spinal Cord Injuries and Paralysis After High-Speed Ejection

Motorcyclists thrown from their bikes often suffer violent impact against the ground or fixed objects, putting the spinal column at extreme risk. When vertebrae are fractured or the spinal cord is severed, victims may experience paraplegia or quadriplegia, depending on the level and severity of the damage.

The Christopher & Dana Reeve Foundation provides in-depth information about spinal cord injuries and reports that nearly one-third of all spinal cord traumas in the United States result from traffic collisions. Once paralysis sets in, victims face lifelong challenges involving mobility, in-home care, and accessibility.

Recovery Options and Legal Support for Paralysis Victims

While some spinal cord injuries are incomplete and allow partial recovery, others result in permanent loss of function. Victims often require customized wheelchairs, home modifications, and round-the-clock caregiving. These expenses can devastate a household financially. Under Idaho tort law, those harmed in a motorcycle crash caused by another person’s negligence may be eligible to recover these future care costs as part of a personal injury lawsuit.

Internal Injuries Are Frequently Overlooked in Initial Evaluations

In many motorcycle crashes, blunt force trauma can rupture internal organs, damage blood vessels, or cause internal bleeding that may not be obvious at the scene. Riders often suffer injuries to the liver, spleen, lungs, or kidneys upon impact with guardrails, pavement, or other vehicles.

The American College of Surgeons stresses the importance of advanced trauma life support and internal imaging in the hours immediately following a severe motorcycle crash. Without CT scans or ultrasound diagnostics, critical injuries can be missed, leading to life-threatening complications later.

Importance of Documenting Internal Injuries for Legal Claims

Internal injuries must be thoroughly documented to support claims for economic damages. Emergency room bills, surgical records, and follow-up care details all play a role in demonstrating the scope of harm. When a case proceeds to settlement negotiations or litigation, these records provide the evidence needed to demand compensation for pain, suffering, and long-term health impacts.

Fractures and Orthopedic Trauma Affect Nearly Every Motorcycle Crash Victim

Motorcyclists are highly susceptible to broken bones during a collision. The most common fractures occur in the arms, legs, ribs, collarbone, and pelvis. High-speed crashes often cause compound or comminuted fractures, which involve multiple bone fragments or bones protruding through the skin.

The American Academy of Orthopaedic Surgeons advises that these types of fractures often require surgical intervention with pins, screws, or metal plates to realign and stabilize the bone. Recovery may take months and may involve multiple operations, physical therapy, and mobility assistance.

Complications and Permanent Disability From Bone Injuries

Even with advanced medical care, some orthopedic injuries do not fully heal. Victims may experience chronic pain, limited range of motion, or arthritis at the injury site. These conditions can interfere with work, daily routines, and quality of life. In legal terms, these are known as “future damages” and are often calculated using expert medical testimony and life care planning assessments.

Road Rash, Lacerations, and Soft Tissue Damage Are More Than Skin-Deep

When a rider slides across asphalt or concrete after being ejected from a bike, the friction causes serious skin abrasions known as road rash. These injuries can range from superficial scrapes to deep tissue damage requiring skin grafts and reconstructive surgery.

The American Burn Association considers third-degree road rash comparable to thermal burns in terms of risk and recovery. The open wounds pose an increased threat of infection and scarring, and the recovery process often includes intense pain, limited mobility, and long-term cosmetic concerns.

Scarring and Disfigurement as Compensable Legal Damages

In Idaho, victims of accidents may seek non-economic damages for disfigurement, especially when facial scarring or visible injuries affect their social, professional, or emotional well-being. These types of injuries often warrant expert consultation with plastic surgeons and psychological specialists when preparing a legal claim.

Psychological Trauma and PTSD Following a Violent Motorcycle Accident

The trauma of surviving a high-speed crash can affect mental health as severely as physical injuries. Many motorcycle accident victims develop post-traumatic stress disorder (PTSD), anxiety, depression, or driving-related phobias. Flashbacks, insomnia, and panic attacks are common even among those who sustained only moderate physical injuries.

The National Institute of Mental Health outlines how motor vehicle crash survivors are at high risk for long-term psychological disorders. Treatment often requires cognitive behavioral therapy, prescription medication, and support from mental health professionals.

Mental Health as a Crucial Part of Recovery and Legal Compensation

Insurance companies often downplay psychological injuries because they are harder to measure. However, Idaho law recognizes emotional distress and PTSD as legitimate components of a personal injury claim. Attorneys must gather documentation from therapists, psychiatrists, and family members to demonstrate the depth of emotional harm.

Pedestrian Seriously Injured in Boise Crash Near Overland and Curtis Roads

A devastating pedestrian crash occurred on the morning of May 26, 2025, at a busy intersection in Boise, Idaho. According to KIVI News, Boise Police responded to reports of a vehicle striking a pedestrian near Overland Road and Curtis Road just after 8:00 a.m. The incident resulted in life-threatening injuries for the pedestrian, who was immediately transported to a nearby hospital for emergency treatment. The area was closed to traffic for several hours as investigators worked to reconstruct the scene and interview witnesses.

This serious crash is the latest in a troubling trend of pedestrian accidents occurring in Boise and across Idaho. While the investigation remains ongoing, the severity of the injuries and the location of the collision raise urgent questions about road safety, driver responsibility, and the legal rights of pedestrians hit by vehicles.

At Montgomery Dowdle, we know that moments like this can be overwhelming for victims and their families. When a loved one is critically injured by a negligent driver, the emotional toll is immediate — but the legal and financial consequences can stretch for months or even years. In this blog, we’ll break down what we know about this incident, explore the broader context of pedestrian safety in Boise, and provide essential legal guidance for victims and their families navigating what comes next.

Why Overland and Curtis Is One of Boise’s Most Dangerous Intersections for Pedestrians

The intersection of Overland Road and Curtis Road is a well-known traffic hub on Boise’s Bench — a heavily traveled corridor where commuter traffic, commercial businesses, and residential neighborhoods converge. While convenient for drivers and pedestrians alike, the intersection has also developed a reputation for being hazardous, especially during peak hours.

High-Speed Traffic and Complex Turning Patterns

Overland Road is a major east-west arterial street that connects commuters to Interstate 84, Boise Towne Square, and downtown Boise. Curtis Road serves as a connector between Overland and several densely populated residential zones. The result? A near-constant stream of vehicle activity — including delivery trucks, local residents, and cross-city traffic — often traveling at high speeds and making complex turning movements through the intersection.

During the morning and evening rush, traffic congestion increases dramatically, and drivers may become impatient or distracted. In these high-volume settings, it only takes a split-second of inattention for tragedy to strike.

Lack of Pedestrian Infrastructure and Visibility Concerns

Despite the intersection’s heavy foot and vehicle traffic, pedestrian infrastructure at Overland and Curtis remains limited. Many crosswalks lack advanced warning signals, raised pavement markers, or pedestrian islands that offer a safe midway point for those crossing multiple lanes.

Poor lighting and visibility — especially during early morning hours, such as when this crash occurred — can make it difficult for drivers to spot pedestrians in time to stop. Shadowed areas, signage clutter, and poorly timed lights may further reduce visibility and increase the risk of collision.

According to the Idaho Transportation Department (ITD), intersections with insufficient pedestrian protections and high-speed traffic are consistently among the top contributors to injury-causing crashes across the state.

Recurring Safety Complaints in the Area

Local residents have previously voiced concerns about safety at this and nearby intersections. Whether it’s speeding vehicles, limited signage, or failure to yield, these recurring problems place pedestrians at constant risk — particularly older adults, children walking to school, and individuals with disabilities.

The May 26 crash is not the first incident in this area — and unless infrastructure improvements are made, it may not be the last.

What We Know So Far About the May 26, 2025 Pedestrian Crash in Boise

As of the latest updates, Boise Police have confirmed that the crash occurred just after 8:00 a.m. on Monday, May 26, near the intersection of Overland and Curtis Roads. The pedestrian was struck by a vehicle under circumstances that remain under active investigation. According to KIVI News, the victim was seriously injured and transported to a local hospital with life-threatening injuries.

Timeline and Initial Police Response

Emergency responders arrived quickly, and both directions of Overland Road were shut down for several hours to allow Boise Police to examine the scene. Traffic was rerouted, and crash reconstruction teams began collecting evidence from the intersection — including possible surveillance footage, skid marks, and witness statements.

No citations or charges had been reported at the time of this writing, though Boise Police have indicated that they are still gathering information to determine whether speed, distraction, or driver negligence played a role.

Time and Conditions May Have Played a Role

The incident occurred during morning commuter hours, a time when drivers are often rushing to work and streets are particularly congested. Visibility during this hour can also be tricky — sun glare, shadows from surrounding buildings, or fog can all reduce a driver’s ability to see pedestrians in crosswalks.

As noted by the National Highway Traffic Safety Administration (NHTSA), pedestrian crashes tend to peak during these transitional parts of the day — early morning and evening — when visibility is reduced but traffic is at its highest.

Witnesses and Camera Footage May Be Key

In cases like this, much of the investigation hinges on nearby surveillance cameras, dashcam footage, and the statements of any bystanders who witnessed the collision. If the driver remained at the scene, law enforcement will also examine their behavior, statements, and whether impairment, distraction, or mechanical issues were involved.

Regardless of the ultimate findings, the crash has already left one individual with devastating injuries — and their road to recovery will likely be long, painful, and expensive.

Common Causes of Pedestrian Accidents in Boise

While every crash has its own unique details, most pedestrian accidents in Boise share common contributing factors — many of which are preventable. At Montgomery Dowdle, we’ve represented numerous victims injured in crosswalks, at intersections, and along roadways just like Overland and Curtis. Understanding the root causes behind these incidents is crucial to both preventing future crashes and establishing liability in personal injury claims.

Distracted Driving in Idaho’s Urban Corridors

One of the most frequent causes of pedestrian accidents in Boise is distracted driving. Whether it’s a driver texting, adjusting a GPS device, eating, or simply daydreaming during a long commute, distraction severely impairs a driver’s ability to see and react to pedestrians in time.

The Idaho Office of Highway Safety reports that distracted driving is involved in more than 20% of injury-causing crashes statewide. Even a momentary glance away from the road can be fatal when a pedestrian is crossing an intersection — particularly during peak traffic hours when quick decisions are critical.

Failure to Yield at Crosswalks and Intersections

Idaho law (Idaho Code § 49-702) requires motorists to yield the right-of-way to pedestrians within marked or unmarked crosswalks at intersections. Unfortunately, drivers in Boise often overlook this legal duty — especially when turning right on red or making left turns across traffic.

In dense intersections like Overland and Curtis, where multiple lanes and turning options increase driver workload, it’s common for pedestrians to be overlooked or ignored. This negligence is not only dangerous — it’s a direct violation of the law and a strong basis for legal action.

Speeding and Aggressive Driving

Speed plays a significant role in the outcome of pedestrian accidents. The faster a vehicle is traveling at the moment of impact, the greater the likelihood of severe or fatal injuries. According to the Insurance Institute for Highway Safety (IIHS), the risk of fatal injury for a pedestrian hit at 40 mph is over 80% — compared to just 10% at 20 mph.

Speeding in school zones, near shopping centers, or through residential areas is a persistent issue in Boise. Aggressive driving behaviors — like rolling through stop signs, racing yellow lights, or tailgating — increase the danger exponentially for those on foot.

Low Visibility and Poor Infrastructure

Lighting, road design, and signage all play a role in pedestrian safety. Many intersections in Boise lack adequate lighting, especially during early morning or evening hours. Shadows from trees, signage clutter, or parked vehicles can make it difficult for drivers to detect pedestrians until it’s too late.

Some intersections are also missing essential pedestrian protections such as countdown timers, flashing beacons, or raised crosswalks. These safety features — common in other urban centers — can dramatically reduce accident rates but are inconsistently implemented throughout Boise’s roadways.

Legal Rights of Pedestrian Crash Victims in Idaho

When a pedestrian is seriously injured by a motor vehicle, the road to recovery extends far beyond the emergency room. Physical pain, financial stress, and emotional trauma can weigh heavily on the victim and their family. Fortunately, Idaho law allows injured pedestrians to pursue legal compensation when their injuries were caused by another person’s negligence. At Montgomery Dowdle, we work closely with victims to ensure their rights are protected and that they receive the full financial recovery they are owed.

Understanding Idaho’s Personal Injury Law for Pedestrians

In Idaho, injured pedestrians have a right to seek compensation for their losses through a civil personal injury claim. These claims are designed to hold negligent drivers accountable and provide relief for medical expenses, lost income, and other damages.

Idaho’s Comparative Negligence Rule

Idaho operates under a modified comparative negligence standard. According to Idaho Code § 6-801, a pedestrian can recover damages as long as they are less than 50% at fault for the accident. If the pedestrian is found partially responsible — for instance, if they were not using a marked crosswalk — their compensation will be reduced proportionally by their percentage of fault.

This makes it especially important to work with an experienced Boise pedestrian injury attorney who can build a strong case and push back against insurance companies that may try to shift blame.

Idaho’s Statute of Limitations for Injury Claims

Under Idaho Code § 5-219, victims of personal injury have two years from the date of the incident to file a lawsuit. If this deadline passes, the claim can be barred permanently — regardless of its strength.

It’s vital to act quickly after a pedestrian accident. Early legal action ensures that vital evidence — like surveillance footage, medical records, and witness statements — can be collected and preserved while still fresh and available.

The Importance of Hiring a Boise Pedestrian Accident Lawyer

After a serious crash, victims are often overwhelmed by medical appointments, insurance calls, and paperwork. Hiring a lawyer not only relieves that burden but also increases your chances of recovering full compensation. At Montgomery Dowdle, our legal team helps clients navigate the legal process with confidence and clarity.

Gathering and Preserving Evidence

Every successful personal injury claim relies on strong supporting evidence. At Montgomery Dowdle, our legal team acts quickly to gather and secure crucial materials that can strengthen your case. This includes obtaining surveillance or dashcam footage that may have captured the collision, collecting eyewitness statements while memories are still fresh, and securing police reports and official diagrams of the crash scene. We also work with your medical providers to document the full extent of your injuries and, when necessary, consult with accident reconstruction experts who can help establish exactly how and why the collision occurred. By acting early, we ensure this vital evidence is preserved and positioned to support your claim effectively.

When evidence is collected early, it becomes much harder for the insurance company to dispute liability or reduce the value of your claim.

Protecting You From Insurance Company Tactics

Insurance adjusters often contact injured pedestrians shortly after a crash — sometimes within hours. Their goal is not to help, but to limit their company’s financial exposure. They may ask misleading questions, request recorded statements, or pressure you to accept a low settlement before you understand the full extent of your injuries.

Your attorney acts as a buffer. We handle all communications with the insurer, ensure that your rights are protected, and fight for a settlement that truly reflects your losses.

Types of Compensation Available to Injured Pedestrians in Idaho

The financial and personal impact of a pedestrian crash can be immense. Idaho law allows injured individuals to recover both economic and non-economic damages based on the facts of the case.

Economic Damages

These refer to tangible, documented financial losses directly tied to the accident. For example, injured pedestrians may face significant medical bills from emergency room treatment, surgeries, follow-up appointments, physical therapy, and prescription medications. In addition to health care costs, victims often lose income while recovering — especially if hospitalization or ongoing pain prevents them from working. In more serious cases, the injury may affect long-term earning capacity, making it difficult or impossible to return to a previous job or career. Out-of-pocket expenses can also add up quickly, including costs for transportation to medical appointments, mobility aids like wheelchairs or crutches, and even modifications to a home to accommodate new physical limitations.

Non-Economic Damages

These damages compensate for the personal and emotional losses a victim experiences after a pedestrian crash — losses that, while not tied to specific dollar amounts, are deeply impactful. Pain and suffering may include chronic physical pain, mobility issues, and the lingering discomfort that disrupts daily life. Emotional distress often follows closely behind, manifesting as anxiety, depression, post-traumatic stress disorder (PTSD), or a general loss of mental well-being. Many victims also report a diminished enjoyment of life, finding themselves unable to return to the activities, hobbies, or relationships that once brought fulfillment. In the most severe cases, a pedestrian may be left with disfigurement or permanent disability — injuries that not only alter physical appearance but can also require long-term care and lifestyle adjustments.

Punitive Damages (In Extreme Cases)

In situations involving reckless, intentional, or egregiously negligent conduct — such as a driver fleeing the scene or operating under the influence — Idaho courts may award punitive damages. These are not intended to compensate the victim, but rather to punish the wrongdoer and deter similar behavior in the future.

Why Early Legal Help Makes All the Difference After a Pedestrian Accident in Boise

When a pedestrian is hit by a vehicle, the aftermath can feel like a blur. Between ambulance rides, ER visits, and insurance calls, it’s easy to delay legal action — especially when your primary focus is on recovery. But what many victims don’t realize is that insurance companies begin building their defense immediately, and crucial evidence can disappear within days. That’s why contacting a skilled Boise pedestrian accident attorney as soon as possible is one of the most important steps you can take to protect your claim and maximize your compensation.

At Montgomery Dowdle, we step in early — preserving evidence, managing insurer communication, and building a powerful case while you focus on healing.

Critical Evidence Can Be Lost Without Immediate Action

Time-sensitive evidence plays a key role in determining fault in a pedestrian accident case. If not preserved quickly, it can be lost or overwritten, weakening your ability to prove liability.

Surveillance Footage and Dashcams

Many pedestrian accidents occur near businesses, intersections, or residential neighborhoods equipped with security cameras or Ring doorbells. However, as reported by Consumer Reports, most of these systems only retain footage for a few days. Without a legal team requesting and preserving this data immediately, it may be gone before your case even begins.

Dashcam video from the driver or a third-party vehicle may also show vital details like the pedestrian’s position in the crosswalk or the vehicle’s speed at the time of impact.

Eyewitness Testimony

Witnesses are often willing to help, but memories fade quickly. According to the National Institutes of Health, memory degradation starts within just hours of an event — especially in high-stress situations like a traffic crash. An attorney can track down and record these accounts promptly, strengthening your claim with firsthand evidence while it’s still reliable.

Vehicle and Scene Documentation

Evidence like skid marks, broken glass, and vehicle damage often disappears within hours. Once cleanup crews clear the area, key information is lost. That’s why pedestrian injury lawyers frequently work with accident reconstruction experts to document crash scenes, calculate speeds, and analyze impact angles using this physical evidence before it’s altered or erased.

Insurance Companies Move Fast — You Should Too

While victims are trying to recover, insurance adjusters are already working to reduce payouts. Their job is to settle fast, pay as little as possible, and limit the company’s liability — even if that means offering a lowball settlement before you understand the full scope of your injuries.

Early Settlement Offers

Insurers often offer settlements within days of the crash. According to the Insurance Information Institute, these quick payouts rarely cover future medical treatment, long-term rehab, or the emotional impact of serious injuries. Accepting a settlement too early — before speaking with an attorney — can permanently prevent you from seeking additional compensation later.

Recorded Statements Used Against You

Insurance adjusters may ask for a recorded statement under the guise of “processing your claim.” However, these recordings are often used to identify inconsistencies, shift blame, or argue that your injuries aren’t as severe as they are. The Consumer Federation of America warns that insurers are trained to manipulate these interactions to their advantage. A personal injury lawyer ensures that you don’t unknowingly say something that could harm your case.

A Legal Team Helps You Focus on Recovery

Beyond gathering evidence and dealing with insurers, early legal support offers something even more important, peace of mind. Managing a claim alone can be exhausting — especially when you’re in pain and overwhelmed with medical treatment.

At Montgomery Dowdle, we take care of every legal detail, coordinating with your doctors, calculating future expenses, preparing legal filings, and negotiating with insurers. Our early involvement means your case is strong from day one — and you don’t have to carry the burden alone.

What Compensation May Be Available After a Boise Pedestrian Injury?

A pedestrian accident doesn’t just cause physical harm — it can turn your entire life upside down. Medical bills begin piling up, time off work creates financial strain, and the emotional fallout of a traumatic crash can last for years. Fortunately, under Idaho law, injured pedestrians are entitled to pursue compensation from the at-fault party to recover both economic and non-economic damages. This includes not only your immediate losses but also long-term consequences that may affect your ability to work, move, or enjoy life.

At Montgomery Dowdle, we help injured victims identify every category of damage they may be owed — and fight to ensure no form of compensation is left off the table.

Economic Damages Covering the Tangible Costs of Your Recovery

Economic damages refer to direct financial losses — the out-of-pocket expenses you’ve incurred or will incur due to the accident.

Medical Expenses Past, Present, and Future

After a pedestrian crash, medical care is often extensive. Victims may face emergency surgery, diagnostic scans, hospital stays, rehabilitation, and even prosthetics or mobility aids. These costs add up quickly, especially without adequate health insurance. According to the National Safety Council, the average cost of a disabling injury in a traffic crash exceeds $100,000. Below are the most common categories of medical-related compensation that injured pedestrians may pursue.

Emergency Room Treatment

The emergency room is often the first stop after a serious pedestrian crash. Victims may undergo X-rays, MRIs, bloodwork, wound treatment, and initial stabilization procedures. ER bills alone can run thousands of dollars and are nearly always included in an injury claim, especially when care is provided out of network or without prior authorization.

Ambulance Transport

Ambulance fees can be surprisingly expensive, especially if advanced life support or paramedic care was required. In Idaho, the average ambulance ride may cost anywhere from $500 to over $2,000 — and that’s not including mileage, equipment usage, or follow-up billing disputes with insurers. These costs are compensable in full when the crash was caused by someone else’s negligence.

Physical Therapy and Chiropractic Care

Rehabilitative treatment is often necessary for injuries to the neck, back, or limbs. Many pedestrians require months of physical therapy to regain mobility, reduce pain, and strengthen injured areas. Chiropractic care and other restorative treatments — while sometimes deemed “optional” by insurance — are frequently vital to long-term recovery and are recoverable in your legal claim when prescribed by a licensed provider.

Medical Devices and Prescriptions

Depending on the nature of the injury, a pedestrian may need medical devices such as crutches, braces, walkers, wheelchairs, or orthotics. These items can be costly and are often not fully covered by insurance. Prescription medications — including pain relievers, anti-inflammatories, and antibiotics — also add up quickly and are considered part of your economic damages.

Ongoing Treatment for Chronic Pain or Permanent Disability

Some injuries never fully heal. In cases involving spinal injuries, head trauma, or severe fractures, the victim may face a lifetime of pain management, follow-up appointments, or even in-home care. These long-term needs must be calculated carefully and supported with medical testimony to ensure that your claim accounts for the full future cost of your care.

An experienced pedestrian injury attorney can work with your doctors to estimate future medical costs and include them in your claim.

Lost Wages and Diminished Earning Potential

If your injuries forced you to miss work — or permanently altered your ability to do your job — you can recover lost wages. In cases of long-term disability, you may also be compensated for lost earning capacity, based on your age, career trajectory, and level of impairment. The U.S. Bureau of Labor Statistics offers wage data commonly used by attorneys and courts to calculate these long-term losses.

Non-Economic Damages Compensating You for Intangible Harm

Non-economic damages recognize that not all suffering has a price tag — but that doesn’t make it any less real. After a pedestrian accident, the impact on a victim’s life often goes far beyond what can be documented on a medical bill or pay stub. Survivors may live with chronic pain, fear of crossing the street, anxiety while walking in public, or a deep sense of loss from no longer being able to participate in activities they once enjoyed. These intangible harms can affect relationships, mental health, and overall quality of life in ways that are difficult to quantify but deeply felt on a daily basis.

Idaho law allows injured individuals to seek compensation for these emotional and personal losses, acknowledging that healing involves more than physical recovery. In many cases, non-economic damages form a significant portion of a personal injury settlement or verdict because they reflect the long-term psychological cost of someone else’s negligence. While insurance companies may try to downplay these impacts, a skilled attorney will ensure that the full extent of your pain, trauma, and diminished life enjoyment is documented and pursued aggressively in your case.

Pain and Suffering

Physical pain following a pedestrian injury can be extreme and long-lasting. Whether you’re dealing with fractured bones, back injuries, or nerve damage, pain can disrupt your ability to sleep, work, and enjoy life. Courts take this into account when awarding non-economic damages.

Emotional Distress and Mental Health Struggles

The psychological trauma after a crash is often as serious as the physical damage. Victims may develop anxiety, depression, or post-traumatic stress disorder (PTSD), particularly when the crash was violent or unexpected. A study by the National Library of Medicine found that PTSD symptoms are common in pedestrian and bicycle crash victims — even years after the event.

You may be compensated for mental health counseling, medication, and the ongoing emotional burden the accident has placed on your life.

Loss of Enjoyment of Life

When injuries interfere with your ability to do the things you love — from hiking to playing with your kids to simply walking around your neighborhood — it’s considered a loss of enjoyment of life. This damage category helps acknowledge that injuries change your lifestyle in deeply personal ways that deserve to be addressed in your claim.

Punitive Damages in Extreme Negligence Cases

While most damages are compensatory — meaning they aim to reimburse your losses — some cases may qualify for punitive damages. These are intended to punish especially reckless or malicious conduct and to deter others from similar behavior.

Punitive damages may apply if the driver who hit you was

Driving under the influence

Racing or speeding excessively

Engaging in road rage or fleeing the scene (hit-and-run)

As explained by Cornell Law School’s Legal Information Institute, punitive damages are rare but powerful in sending a message and increasing the total recovery in your case.

Wrongful Death Claims After a Fatal Pedestrian Accident in Boise

In the most tragic cases, a pedestrian accident doesn’t result in injury — it results in the loss of a life. These devastating events leave families grieving, overwhelmed, and unsure of how to move forward. While no legal action can bring back a loved one, Idaho law provides a pathway for surviving family members to seek justice and financial relief through a wrongful death claim.

At Montgomery Dowdle, we help families navigate this deeply painful process with compassion and clarity, making sure their rights are protected every step of the way.

What Is a Wrongful Death Claim in Idaho?

A wrongful death claim is a civil lawsuit brought on behalf of a deceased person when their death was caused by another party’s negligence, recklessness, or wrongful act. In Idaho, these cases are governed by Idaho Code § 5-311, which allows certain surviving relatives to file suit against the at-fault party — such as a negligent driver who struck a pedestrian.

This type of claim seeks to recover damages not for the victim’s injuries themselves, but for the losses suffered by the surviving family members, including funeral expenses, emotional trauma, and lost income.

Who Can File a Wrongful Death Claim in Idaho?

Not everyone who is emotionally affected by a loss can file a wrongful death lawsuit. Idaho law limits eligibility to specific parties who had a close relationship with the deceased.

Surviving Spouse or Domestic Partner

The surviving spouse is typically first in line to bring a wrongful death action. They may recover damages for lost companionship, support, and the shared financial contributions of the deceased.

Children or Dependent Minors

Biological or adopted children of the deceased may also file a claim. If the children are minors, the court may appoint a guardian to act on their behalf to ensure their long-term interests — such as education and financial stability — are protected.

Parents of a Deceased Minor Child

If the pedestrian victim was a child, the parents are entitled to pursue damages, including for the loss of the child’s potential earnings and the profound emotional toll such a loss brings.

Estate Representative

If none of the above relatives survive, the personal representative (executor) of the deceased’s estate may file a claim on behalf of the estate and distribute any recovered damages to eligible heirs.

Types of Compensation in a Boise Wrongful Death Case

The damages available in a wrongful death claim differ somewhat from those in personal injury cases and are meant to reflect the full scope of the family’s financial and emotional losses.

Funeral and Burial Expenses

The cost of laying a loved one to rest can exceed $10,000 when accounting for caskets, services, burial plots, and travel arrangements. These costs are fully recoverable in a wrongful death claim.

Loss of Future Income and Benefits

If the deceased was a wage-earner, the family may recover compensation for the financial support they would have provided over their lifetime. This includes lost wages, health insurance, retirement contributions, and other employment benefits. The U.S. Department of Labor provides data often used to calculate these long-term losses based on occupation, age, and education.

Loss of Companionship and Emotional Support

While intangible, the emotional loss suffered by a spouse, child, or parent is one of the most significant aspects of a wrongful death claim. Idaho courts recognize the value of parental guidance, spousal companionship, and emotional stability — and allow compensation for these losses, even though they can’t be measured in dollars.

Medical Expenses Prior to Death

If the victim received emergency treatment before passing, any resulting medical bills — including ambulance transport, ICU care, or surgeries — are also compensable through the estate or survival action.

Statute of Limitations for Wrongful Death Claims in Idaho

Under Idaho Code § 5-219, surviving family members generally have two years from the date of the pedestrian’s death to file a wrongful death claim. Waiting beyond this period may result in the court dismissing the case entirely, regardless of its merits.

That’s why it’s critical to contact an experienced wrongful death attorney in Boise as soon as possible — to preserve evidence, identify liable parties, and ensure your case is filed within the legal timeframe.

How Fault Is Determined in Boise Pedestrian Accidents

Determining who is legally responsible for a pedestrian crash is the foundation of every personal injury or wrongful death claim. In Boise and throughout Idaho, fault is assigned based on a combination of physical evidence, witness accounts, traffic laws, and the circumstances of the collision. Unfortunately, drivers — and sometimes even insurance companies — may try to shift blame onto the pedestrian to reduce their own liability. That’s why building a clear, fact-supported case is so essential.

At Montgomery Dowdle, we conduct thorough investigations and partner with crash reconstruction experts when needed to ensure fault is assigned fairly and accurately.

Legal Standard Negligence and Duty of Care

All drivers in Idaho have a legal duty of care to operate their vehicles safely and avoid harming others — especially pedestrians, who are the most vulnerable users of the road. When a driver fails to uphold this duty — by speeding, texting, failing to yield, or driving under the influence — and that failure causes injury or death, they are considered negligent under Idaho law.

As noted by Idaho Code § 49-702, drivers must yield the right-of-way to pedestrians crossing within a marked or unmarked crosswalk at an intersection. Violating this rule is often enough to establish driver negligence.

Evidence Used to Prove Fault in Pedestrian Cases

To determine who is at fault, your legal team will collect and analyze a wide range of evidence, including the following.

Crash Scene Photos and Vehicle Damage

Photos showing skid marks, impact angles, and road conditions help illustrate how the crash occurred and whether the driver had enough time and distance to avoid the collision. Damage to the vehicle’s front end often aligns with pedestrian strikes and can help confirm speed and point of contact.

Surveillance and Dashcam Footage

As noted by the National Association of City Transportation Officials (NACTO), video footage is one of the most powerful tools in proving pedestrian right-of-way violations. Surveillance from nearby businesses or residential doorbell cameras may show the pedestrian legally crossing and the vehicle failing to stop.

Police Reports and Citations

If officers responded to the scene, their accident report becomes an important part of the legal record. This document often includes witness statements, weather conditions, a narrative of the crash, and whether any citations were issued — such as for speeding, failure to yield, or distracted driving.

Eyewitness Testimony

People who witnessed the crash can offer invaluable insight into what happened — including whether the pedestrian was in the crosswalk, if the driver was distracted, or how fast the vehicle was traveling. These statements can clarify disputed facts and support your version of events.

Comparative Fault in Idaho Pedestrian Cases

Idaho uses a modified comparative negligence rule (Idaho Code § 6-801), meaning that if a pedestrian is found to be partially at fault, their compensation will be reduced by their percentage of fault. However, if the pedestrian is deemed 50% or more responsible, they may be barred from recovering any compensation at all.

This makes it especially important to counter any arguments that the pedestrian “darted out,” was outside a crosswalk, or failed to obey traffic signals. Insurance companies often exploit these claims to minimize their payout — but a skilled attorney can push back with evidence and legal precedent.

Law enforcement agencies make thousands of DUI arrests annually, but that doesn’t stop everyone. This fear can have long-term effects on how people perceive their surroundings and influence their daily activities.

How Montgomery Dowdle Can Help in the Case of Tragedy Caused by Driving Drunk

These cases require aggressive legal action. While criminal charges may be filed, they do not compensate victims or their families for medical expenses, lost income, and emotional suffering. Additionally, collecting from these defendants may pose special problems as they generally face other proceedings along with the insurance claims the victims will file. A civil claim holds the impaired driver financially accountable.

At Montgomery Dowdle, we understand the devastating toll these accidents take on victims and their families. The physical pain, emotional distress, and financial burdens can feel overwhelming. That’s why we are committed to fighting for those who have suffered due to someone else’s negligence. We aggressively pursue maximum compensation, covering medical expenses, lost income, pain and suffering, and any other damages our clients are entitled to. Whether through strategic negotiations with insurance companies or taking the case to court, we refuse to back down. Our goal is to hold negligent parties accountable and help victims regain stability and justice. Our process is as follows:

These Cases Need Thorough Investigation

First and foremost, we conduct a thorough investigation, which is key to building a strong case. Such investigations may involve the collection of toxicology reports, witness statements, and crash reconstructions. Toxicology reports show if substances like alcohol or drugs contributed to the crash, while witness statements provide crucial firsthand accounts. Crash reconstructions use evidence like skid marks and vehicle damage to clarify the accident’s cause. An experienced legal team knows how to gather, preserve, and present this evidence effectively, ensuring it proves liability and helps secure fair compensation for the victim.

Insurance Negotiations Need a Skilled Intermediary

Insurance companies often prioritize minimizing payouts, offering lowball settlements that don’t fully cover a victim’s damages. They may downplay injuries or pressure victims into settling quickly before they understand the long-term effects. A skilled attorney pushes back, ensuring the settlement accounts for all damages, including medical bills, lost wages, pain, suffering, and future care. Without legal representation, victims risk accepting far less than they deserve, leaving them financially burdened. Attorneys are essential in securing fair compensation and ensuring victims are fully informed.

Victims Need Moral Support

Recovering from a tragic accident is emotionally overwhelming, and the right legal team provides more than just legal guidance—they offer support and understanding. A compassionate lawyer listens to your concerns, handles the complexities of the case, and ensures your voice is heard. Knowing someone is fighting for your rights can lighten the emotional burden, allowing you to focus on recovery while they manage the legal details. This support makes a challenging time more bearable.

When Cases Go to Court, They Need Skilled Advocacy

Some drunk driving cases don’t settle out of court, and when litigation is necessary, victims need strong legal representation. A skilled attorney thoroughly investigates the case, organizes the evidence, and presents a compelling argument in court. From questioning witnesses to making persuasive closing arguments, an experienced lawyer fights to secure justice and fair compensation for the victim. Strong legal representation can make all the difference in achieving a favorable outcome and ensuring the victim is fully compensated.

Beware of Predatory Insurance Companies

Insurance providers are primarily focused on protecting their bottom line, not the interests of accident victims. Their goal is to minimize payouts, even when a claim is valid, and the damages are significant. Companies may use a range of tactics to reduce the amount they pay, such as questioning the severity of injuries, disputing liability, or delaying the claims process to wear down the victim. In some cases, they might pressure victims into accepting a quick, lowball settlement before they fully understand the long-term effects of their injuries.

Understanding these tactics is crucial for ensuring fair compensation. Victims need to be aware that insurance companies are programmed to act in their own interest, not in the interest of the injured party. With the right legal representation, victims can counteract these strategies and secure a settlement that truly reflects their damages. Experienced attorneys know how to navigate the claims process, investigate the full extent of the injuries, and gather the evidence needed to fight for a fair settlement. By working with a strong lawyer, victims can ensure their rights are protected and avoid being taken advantage of by insurance companies.

Insurance Companies Survive on Minimizing Payouts

Insurance companies train adjusters to minimize claim values by downplaying injuries and questioning liability. Adjusters may argue that the injuries aren’t severe or that the accident wasn’t entirely the insured party’s fault. Without legal representation, victims risk losing the compensation they need for medical bills, lost wages, and other damages. Our lawyers and staff can counter these tactics, ensuring all damages are accounted for and preventing victims from accepting inadequate settlements before understanding the long-term effects.

Adjusters Tend to Blame the Victim

Insurance companies often try to shift the fault onto the injured party by claiming the victim wasn’t paying attention or contributed to the crash. These tactics aim to justify a lower settlement or deny the claim. A strong legal team helps counter these tactics by gathering evidence, such as witness statements or video footage, to prove the victim wasn’t at fault. With skilled representation, victims are less likely to be unfairly blamed and more likely to receive the compensation they deserve.

Companies Try to Distract the Victim with Unfair Initial Settlements

Another trick is offering quick, lowball settlements, hoping victims will accept before understanding the true cost of their injuries. These initial offers are typically much lower than what the victim is entitled to. Once accepted, the victim forfeits the right to pursue further compensation, even if additional complications arise later. It’s essential for accident victims to consult with an attorney before accepting any offer to ensure they are fully informed and receive fair compensation.

Accident Victims Need the Services that Insurance Companies Promise

Insurance is meant to provide financial protection after an accident, but when companies fail to meet their obligations—offering insufficient settlements or denying claims—legal action becomes necessary. A dedicated attorney can advocate for victims, ensuring they receive the compensation they are owed. By handling negotiations and gathering evidence, we can help ensure victims aren’t taken advantage of and that they are fairly compensated for medical bills, lost wages, and long-term effects.

There are numerous misconceptions floating around about personal injury claims. This is concerning in that when people are not properly informed they may fail to make a claim and collect money they are entitled to for injuries or they may make costly mistakes in the claim process which can result in lost compensation.

Read more to learn about some of the most common misconceptions about personal injury claims:

I was involved in a vehicle accident and the other driver did not have insurance, so there is no reason to make a claim. This is false.

There may be other available resources which provide for you to recover compensation. As an example, you may be able to collect compensation by your own insurance company if you have uninsured or underinsured coverage. If the other driver was employed and on the job at the time of the accident, his/her employer might be responsible. The point is that you owe it to yourself to explore all of these options. The attorneys at Montgomery Dowdle will review all of these possibilities with you concerning your personal injury claim.

If I do make a claim, I will have to attend court and I don’t have the time for that. This is also false.

A very high percentage, over 80% of personal injury claims are settled out of court without you needing to attend any court hearings. In addition, your attorney will handle the negotiations with the insurance company and your opponent, which will reduce any of your time that would be spent on the case.

The insurance adjusters are on my side. This is false.

Like any business, there are good and bad insurance adjustors. However, even good insurance adjustors work for the insurance company and their loyalties are to the insurance company, not you. It is not their job to determine what is fair in each personal injury claim. Their job is to settle the claim for the smallest amount, so they will try to pay you as little as possible. In this way, the company makes more money and they look good in the eyes of their supervisors.

The examples above are just a few of the more common misconceptions that people may have about personal injury claims and personal injury attorneys. If you are involved in an accident, it is not wise to rely on what others or insurance adjusters tell you about your injury claims. Even though they mean well, misinformation could ultimately be very costly when it comes to your claim.

The best thing to do is to consult with an experienced personal injury attorney. They can explain your rights, answer your questions and give you ideas of what your personal injury claim may be worth.

You can call a Boise Personal Injury Lawyer at Montgomery Dowdle any time. Your consultation is free and you get the benefit of more than 35 years of experience in personal injury law and insurance claims. Call Now. 208-378-8882

When I first visit with Clients, they usually want to know what happens when they hire an attorney. What’s the process? What are the fees? How long does it take? How will they pay their medical bills? These are all great questions.

So I put together a quick overview of the entire process to help give you a feel of what you can expect if you hire an attorney. Over the next few weeks, I’ll be adding articles to expand on each step in the process, so be sure to check back.

Step 1: Free Evaluation

First thing you want to do is meet with an Attorney you think you might want to represent you. This can happen by phone, by video conference or in person. The attorney will ask you simple questions about your case, explain what kind of damages you are entitled to recover, answer any of your questions about the legal process, and explain how a ‘contingency legal fee’ works.

Step 2: Hire – ‘Retaining’ – an Attorney

Once you’ve found an attorney you want to hire, you sign an agreement called a ‘Retainer.’ This simple agreement lists what he or she will be obligated to do in your behalf, and what his or her legal fee will be.

Step 3: A Letter of Representation

First step for your newly hired attorney is to notify the ‘At Fault’ insurance company that he or she is representing you. This is called a ‘letter of representation.’ The ‘at fault’ party is usually referred to as the ‘Defendant.’

Step 4: Gathering Medical Records

Next your attorney will work with you to gather all your medical records and bills. Often, if you need help finding the right doctor, an experienced attorney can make recommendations.

Step 5: Working with Creditors

If you are being harassed by creditors, your attorney can contact the creditors and work out an agreement with them so they stop calling and writing you until the case is resolved.

Step 6: Demand Letter

When you’ve completed your medical treatment, your attorney will prepare a ‘Demand Letter.’ This typically includes:

a statement of the facts of the accident

an explanation of why the defendant was negligent and liable for damages,

a summary of your treatment,

an itemization of your medical bills,

a discussion of damages you are entitled to recover,

and a demand for a specific amount of settle your claim.

A complete set of your medical records and bills will be sent with the demand letter, which is usually referred to as the ‘demand package.’

Step 7: Negotiate a Settlement

Your attorney will aggressively negotiate with the claim representative for the defendant’s insurance company to settle your claim for the highest amount possible. He or she will keep you advised of each step of the negotiating process, and will not agree to any final settlement without your approval.

Step 8: Release

If a settlement is reached, your attorney will process all the settlement documents, including the formal ‘Release’ you have to sign. The Release sets forth the amount you will receive in exchange for releasing the Defendant from any further liability for damages.

Step 9: File Suit

If a settlement cannot be reached, your attorney will file a lawsuit for you. An experienced attorney can settle 90% of all cases he or she is retained to handle, for the top dollar amount, without needing a lawsuit.

Step 10: Mediation

After filing suit, your attorney will attempt to resolve your claim through ‘mediation,’ which is an informal process where both sides come together with a 3rd party acting as an impartial arbiter. This process is non-binding, but often helps get the case settled.

Step 11: Preparing for Trial

If your case goes to trial, your attorney will guide you through the process. I’ll go into more detail on this in another post, but it involves answering written questions from the defendant’s attorney called ‘Discovery,’ and undergoing a ‘deposition’ where the defendant’s attorney will ask you questions about your case. Your attorney would represent you at the deposition.

This is just a quick overview of the process, but hopefully it helps answer some of the basic questions you have about the legal process. One of the easiest things to do is have a simple evaluation with an attorney. This is a very casual conversation, where you can ask questions and get answers, and determine if submitting a claim is a good idea for you.

When children are injured in playground accidents, the medical bills and family stress can mount quickly.

Personal injury claims are an effective means of providing compensation to both the child and the family who must care for him or her. A minor is typically not able to navigate the legal system alone, but parents can pursue claims on behalf of the child to recover damages for medical bills and pain and suffering.

Injuries from Playground Accidents

Playgrounds at city parks, schools and day care centers are supposed to be safe places where kids can have fun.

Yet every year, according to the Centers for Disease Control and Prevention (CDC), more than 200,000 children under the age of 14 head to the emergency room for treatment for playground-related injuries.

Most of these injuries — about 75 percent — happen at public playgrounds.

Though bruises and other minor injuries often occur at playgrounds, many playground accidents result in more severe harm. The CDC estimates that roughly 45 percent of these incidents involve fractures, concussions, dislocations, amputations and internal injuries.

Common Causes of Playground Accidents

While unsafe behavior by children can lead to injuries, many playground accidents are caused by faulty equipment.

Schools, parks and other play areas often have equipment that is years or even decades old. Without regular inspections and maintenance, the play structures can become dangerous. Metal bars and chains develop rust, hardware loosens or wood components begin to rot, for example.

But even new equipment isn’t always safe, as some playgrounds are not designed to properly address injury risks.

Personal injury claims for playground accidents are not always based on unsafe equipment, either. In many cases, a lack of adequate supervision is the cause of injury.

Though the law does not have any definitive rules regarding what is considered to be adequate, schools and day care centers are legally obligated to take reasonable steps to ensure children’s safety.

Liability for Playground Accident Personal Injury Claims

The owner of the playground may be named in an accident claim.

For injuries that occur at public parks, the local municipality is usually responsible for maintenance. With national parks, however, maintenance is generally in the hands of the federal government.

Playgrounds at public schools are typically owned by the school district. Play areas also may be owned by private schools, day care facilities, churches or companies.

Aside from the playground owner, others may be held legally responsible for injuries.

If the design or construction of the playground was a factor in causing an injury, the company responsible for providing or installing the equipment may be held liable. And, if negligent supervision contributed to or caused the accident, the adults who accepted responsibility for supervision may be sued for damages.

In Idaho, personal injury statutes provide you with a means to recover financial compensation for harm you have suffered due to someone else’s negligence or intentional actions.

But as for how much money you can recover, the sky isn’t the limit. Like many other states, Idaho has statutes that place limits on some types of compensation.

Non-Economic Damage Cap for Idaho Personal Injury Claims

Expenses related to your injury that can be calculated from records and documents are referred to as economic damages.

These may include current and future medical bills, lost wages, lost future earning capacity and damages to property. Compensation for economic damages is not limited by our state’s personal injury laws.

Non-economic damages, however, do have a cap on the amount that can be recovered in a personal injury claim.

These damages — which include pain and suffering and loss of enjoyment of life — are considered subjective, and high awards are believed to strain the overall economy. As such, Idaho has enacted a cap of $250,000 on non-economic damages in injury cases.

Punitive Damage Cap for Idaho Personal Injury Claims

Both economic and non-economic damages are intended to compensate the victim for the injury.

Punitive damages, on the other hand, are intended to punish intentional misconduct and deter the defendant and others from similar actions in the future. These damages are awarded in only a small percentage of injury lawsuits.

In order to obtain punitive damages in Idaho, personal injury claims must prove that the defendant’s conduct was fraudulent, malicious, oppressive or outrageous. And the amount that may be awarded is limited.

State law requires that judgments for punitive damages do not exceed the greater of $250,000 or three times the amount of the compensatory damages.

Collecting Compensation from Multiple Defendants

In most Idaho injury cases, if more than one defendant is found to be at fault, each will be required to pay a percentage of the damages that equals their proportionate liability.

It doesn’t matter if one defendant is more than capable of shouldering the entire amount of the injury claim or if another is nowhere to be found or is penniless. Each will only be legally responsible for his or her share of the award.

With some injury claims, however, joint and several liability applies.

This means that, even if multiple defendants were responsible for the injury, the plaintiff could pursue a claim to recover the entire judgment from any one of the defendants. In Idaho, joint and several liability is limited to cases in which a person acted as an agent of another party, or where multiple parties acted in concert to intentionally or recklessly commit harm.

Have you suffered harm because of someone else’s carelessness or intentional misconduct? The professionals at the Montgomery Dowdle are experienced in recovering the maximum compensation personal injury claims.

Vehicle accidents involving pedestrians frequently take a high toll on the victims.

According to the National Highway Traffic Safety Association (NHTSA), 4,735 pedestrians were killed in accidents with vehicles in 2013, representing 14 percent of all traffic fatalities. Another 66,000 pedestrians were injured in traffic accidents.

What are your risks? And what should you do if you are a pedestrian victim of a car crash?

The High Risk of Pedestrian-Vehicle Accidents

Statistically speaking, male pedestrians are more likely to be injured or killed in vehicle accidents.

In fact, the NHTSA reports that more than 69 percent of pedestrians killed in traffic crashes in 2013 were male.

Collisions involving pedestrians most often occur in urban areas at non-intersection locations. Time of day is also a factor, with most of these accidents occurring after dark. Alcohol use, by the driver and/or pedestrian, also plays a part in many pedestrian-vehicle collisions.

Personal injury claims for those traffic accidents causing harm to pedestrians typically consider the duty of care of both the driver and the pedestrian. Drivers are obligated to exercise reasonable care behind the wheel, while pedestrians have a duty to care for their own safety.

Failure to do either may be considered negligence.

What to Do if You Suffer a Personal Injury

For victims of pedestrian-vehicle accidents, the first step is to take care of your health and safety.

Move away from oncoming traffic, if possible, and seek immediate medical attention. If you or someone with you is able, document everything. Take photos of the accident scene as well as your injuries.

Be sure to keep track of medical bills. It is also important to maintain accurate records regarding lost work and non-economic losses, such as pain, suffering and loss of companionship.

Do not sign any papers with the insurance company until you have spoken with an experienced personal injury attorney.

If you accept a settlement or inadvertently sign any document that limits your rights to file a claim, you will not be able to pursue further compensation should you need additional medical care in the future. Also, never consent to a recorded interview with the insurance adjuster.

If the adjuster is insistent, be sure to have your attorney present to protect your legal rights.

Filing Legal Claims for Pedestrian-Vehicle Accidents

The insurance company may fight your personal injury case, blaming pedestrian negligence for the collision.

For anyone filing a personal injury claim, navigating the intricacies of the legal system can be difficult.

Mistakes are all too common when you attempt to wade through this process by yourself, and unfortunately, this can cost you in the form of a reduced settlement amount. In some cases, the court may reject your claim if you miss a critical deadline or make in error in filing legal documents.

Today we would like to discuss some of the most common errors accident victims make in their lawsuits. Avoiding these pitfalls will help you recover the compensation you deserve for your injury.

Misrepresenting Facts in an Injury or Accident Claim

It is important to be accurate when speaking about your injury.

You may have symptoms that change or worsen days after the accident. Make sure you are thorough when reporting symptoms, so that you get the medical attention you require.

But don’t exaggerate or minimize your symptoms, as any discrepancies could be used as a basis for diminishing your settlement or rejecting your claim.

Failing to Follow Treatment Plans for your Accident Injury

Emergency room doctors may instruct you to obtain further treatment from a medical specialist or your regular physician.

Make these appointments in a timely manner, as seeking medical care is essential to both your health and the future of your lawsuit. Follow the recommendations of the doctors you visit, and do not leave any gaps in treatment.

The insurance company could attempt to use actions like missing appointments or failing to obtain continuing medical care as evidence to show that you have recovered or that your injuries are not severe.

Also, if you are advised to wear a medical device such as a neck brace, follow the doctor’s instructions diligently. The same goes for avoiding any activities that your medical team advises against.

Going Without Personal Injury Legal Advice

The insurance adjuster will likely ask you to sign a medical authorization form or other documents, and they may request a recorded statement as well.

Do not consent to either until you have spoken with a personal injury attorney.

After all, the insurance company wants you to settle your claim for as little as possible, and any information you provide could be used against you. A lawyer can ensure that you do not inadvertently sign away your rights and that you do not say or do anything that could negatively affect your claim.

And finally, above all, do not accept an insurance settlement without consulting with an experienced attorney.

In many cases, claimants make the mistake of settling too soon, before they fully understand the extent of their injuries. And, of course, insurance adjusters often make a low settlement offer which only represents a fraction of the compensation you deserve.

By retaining legal representation, you can achieve the best possible outcome from your personal injury claim. The legal team at the Montgomery Dowdle in Boise, Idaho, can make sure that your case is handled the right way from start to finish.
