<p>For example, one <strong><span style="color: #004881;">widely cited research study by the CDC</span></strong> indicates that pit-bull-type dogs and Rottweilers are the most dangerous breeds. As a result, laws have been adopted in many areas that place restrictions on owning these and some other breeds.</p>
<p>People who are harmed by these banned breeds, as well as other animals, can file legal claims against the responsible parties to recover financial compensation for their injuries and losses.</p>
<h2>Breed-Specific Legislation</h2>
<p>No dog breed is nationally banned, but each municipality has the right to develop its own laws regarding those animals that may be considered dangerous.</p>

<p>Pit bulls have been declared “dangerous” or “vicious” in several cities, including Kellogg and Preston. Some cities, including Fruitland and Preston, have banned ownership of these dogs, and presa canarios and cane corsos are also banned in some local municipalities. Russian wolfhounds, wolf hybrids and mountain dogs are also specifically named in Idaho statutes.</p>
<p>People who are found to own a banned breed can be fined hundreds of dollars. And when dog bite injuries occur, the animal may be quarantined or destroyed. Beyond that, owners may be held legally responsible for the attacks.</p>

<p>Bites can occur in a variety of situations, but many of these are preventable. It may be difficult to determine who is at fault in a <strong><span style="color: #3366ff;">dog bite case</span></strong>, but experts agree that prevention is the best approach. Read on for some helpful tips to help your child avoid being bitten by a dog.</p>
<h2><strong>How Bites Occur</strong></h2>
<p>In some cases, kids may have a negative encounter with a friend’s or family member’s pet while visiting their home. Dogs are territorial, and a variety of stimuli can incite a negative response in their home. In other cases, the encounter may take place outdoors, either with a loose dog or one that is on a leash with its owner. In most cases, however, children are bitten by dogs when adult supervision is absent, when the dog is chained outside and the child comes within reach, when the dog is eating or when more than one dog is present.</p>

A child should practice Milan’s “No Talk, No Touch, No Eye Contact” rule. This both demonstrates respect for the dog and establishes the human as the pack leader.</p>

				<div class="et_pb_text_inner"><p><a href="https://www.montgomerydowdle.com/"></a>Many kids really like dogs while some are frightened of them.  Unfortunately, many <span style="color: #3366ff;"><strong>dog bite cases</strong></span> involve kids.  Helping a child steer clear of a bite incident is the goal, but that’s not always possible.</p>
<p>Idaho law provides that dog owners can be held liable in how they keep and control a dog when if it bites or causes injury to an individual.  A dog owner owes a duty of care to keep their dogs within the standards required by of the law.</p>
<blockquote><p><span style="color: #3366ff;"><strong>Idaho Code § 25-2805(2))</strong></span> defines a vicious animal as “[a]ny animal which bites, inflicts injury, assaults or otherwise attacks a human being.”</p></blockquote>
<p>The statute requires any vicious animal to be confined in an enclosure.  This is true even the owner may not have known the dog had a propensity to bite.</p>
<p>The Idaho Supreme Court has long rejected the old common law rule that provided a vicious animal could attack without consequence to an owner.</p>
<blockquote><p>The Court has further rejected the “familiar but fallacious saying that every dog gets one free bite before its owner can be held to be negligent for failing to control the dog.”</p></blockquote>
<p>This is not the current law in Idaho with respect to dog bites.  Thus, an owner can be held liable for a dog bite even if it’s the first time the dog has bitten someone.</p>
<p>If a dog owner is found liable for a dog bite, then Idaho law provides that they can be ordered to pay for all medical bills, including future medical bills caused by the dog bite.  They may also be required to pay for disfigurement caused by scarring and emotional damage caused by the dog bite. If there are any disabilities or other issues caused by the dog bite, then the owner may be liable for those as well.</p>
<p>Even though the dog bite law in Idaho may hold the owner liable and provide for the payment of damages, prevention in teaching your child how to act around dogs is “preventive medicine” worth the time.   This will help minimize the chance of your child being injured by a dog bite.</p>
